TAKE TWO AND CALL ME IN THE MORNING

The Professional Activities Committee is working full speed ahead to
enhance services to our membership and is happy to report that the Doctor is
in the house!  Pinhas Friedenberg, (affectionately know as the FERPA Doc),
has agreed to help restart the FERPA and Legal Issues page on the MSACROA
web site.  The page has been revived with some of his advice on issues on
which he has been consulted in the past.  Please note that Pinhas is not an
attorney and is not giving you any legal advice.  As a seasoned registrar in
our profession he is sharing with us some of his experiences, thoughts and
opinions.

If you have a concern and would like to pick Pinhas' brain, feel free to
write to him.  When you send in your question, make sure that you also
include your phone number, just in case he needs further clarification.
Sometimes you may get your answer by a phone call.

Student safety
A student is experiencing some mental health and drug addiction problems, which required hospitalization a few weeks ago. While there is no evidence of the student being in immediate danger to him/herself, the potential for harm does exist. To date, the student has not signed a non-directory information release for his/her parents. The College believes [...]

Student record use in research
Yesterday one of our administrators asked me if, when doing research for his dissertation, can he access the records of our students? For example, he may [among other things] need to compare pre-tests with post-tests results of students enrolled in our vocational programs. He is also considering trying to correlate academic progress of students who [...]

Social Security Number use
I have a question re: the use of social security numbers. Our development office wishes to have a private company locate our graduates from the 90’s. There is one price if we supply them with a list of names versus a much lower price if we provide the names and Social Security Numbers. Can we [...]

Issuing Diploma
I have the following situation: a student graduated last year, but did not pick up her diploma because it was printed with a name she was (perhaps still is) in the process of changing. She has not left us a forwarding address or instructions about sending her diploma, nor has she provided us with documentation [...]

SENIOR COLLEGE RECRUITERS
This topic has become a big issue at this campus. The question has come up as to whether or not we can share with college recruiters the names and addresses of potential candidates who have filed for graduation so that the student can be invited to attend a college fair? We are not provided the name of [...]

mailing list
Pinhas, An easy question for you…Are we safe with FERPA if we give a list of our students to Kean U. for a mailing?  We have a special agreement with Kean, Ocean@Kean,  and thus I want to be sure we aren’t breaking any FERPA policies giving them a list for one of their mailings about [...]

Social Security Number – To Use or Not to Use
Dear Pinhas, Thank you for taking time to talk with me last week. As I mentioned, we have learned several institutions in New Jersey have either stopped, or plan to stop posting social security numbers on their paper and electronic transcripts. What is your understanding of any Federal and/or State legislation regarding the posting of [...]

Parents and payments
Most undergraduate student bills are paid by the student’s parents. A common question is how should the Bursar handle a parent who comes to the window and wishes to pay his/her son/daughter’s bill. If the parent shows up with [...]

STUDENT AND PARENTS RIGHTS. WHERE DO THEY BEGIN AND WHERE DO THEY END.
Posted to REGIST-L, December 23, 1997 Updated June 30, 1998 Since this question has come up so many times, I feel that I need to take the time to clarify the issue. For those that heard me on the subject, and know my position, stop reading. For others, I hope that I succeed in clarifying the issues. LeRoy [...]
